Food business operator and director fined for breaching food safety law

A food business operator and its director have been fined a total of £8,614 for failing to comply with a hygiene improvement notice issued by Bassetlaw District Council.

Environmental Health Officers visited the White Swan in Dunham on Trent on 21st August 2025 and served the notice on Rescom Freehouse Ltd who were the proprietors of the premises.

The failings included ineffective cleaning of premises and equipment, out-of-date food on the premises with no effective procedure in place to rectify this, and failure to train staff in procedures to ensure food hygiene and safety.

A follow-up inspection on 11th September 2025 confirmed the hygiene improvement notice had not been complied with.

At Mansfield Magistrates Court on 5th March 2026 both the company and its Director, Kevin Sprague, pleaded guilty to failing to comply with a hygiene improvement notice, with Rescom Freehouse Ltd ordered to pay £8,000 in fines, £2,000 in victim surcharge and £1,300 in costs, while its director was ordered to pay a £614 fine, victim surcharge of £246 and costs of £1,300.

Environmental Health Officers also confirmed the director has since made positive changes to the way the White Swan is managed.

Cllr Darrell Pulk, Cabinet Member for Neighbourhoods said: “We will take robust action where businesses fail to comply with statutory food safety law, with those failing to meet legal requirements face prosecution and as in this case significant financial penalties.

“We continue to support businesses in achieving food safety compliance, while also protecting public health and maintaining confidence in local food establishments.”
