Nuisance Vehicle Public Spaces Protection Order 2025.
Bassetlaw District Council (“the Council”) has made the following Public Spaces Protection Order pursuant to Section 59 of Anti-Social Behaviour Crime and Policing Act 2014 (“the Act”) after undertaking a consultation as required by Section 72 of the Act.
The land described by the map in Schedule 1, edged in red being land in the area of the Council is land to which the Act applies and is protected by this Order
The Council is satisfied that activities have been carried out in the Designated Area that have had a detrimental effect on the quality of life of those in the locality. The Council is further satisfied that the effect of these activities is likely to be of a persistent and continuing nature, and is of such as to make the activities unreasonable and the effect of the activities justifies the restrictions imposed.
The Council makes this Order as people have been gathering in the Designated Area and acting in a manner causing nuisance, annoyance, harassment, alarm and distress to those in the locality. The consumption by those acting in a manner which is causing the nuisance, annoyance, harassment, alarm and distress of alcohol and illegal substances is a prevailing factor. The activities have caused those living and visiting the Designated Area to make complaints both to the Council and the Police.
The Council and the Police have also collated evidence from local residents and those who work in businesses situated in the Designated Area who state:
- public space is being misused
- there is a disregard for community / personal well-being
- acts directed at people
The Order may be cited as the Nuisance Vehicle Public Spaces Protection Order 20XX and takes effect from 1 April 2026 until 30 March 2029.
The following prohibitions are imposed on use of the Designated Area: between 12noon and 6am:
- Engaging in, promoting, encouraging or assisting in the carrying out of any anti-social behaviour connected to the use of any vehicle in the Restricted Area. This includes but is not limited to
- sounding of horns (other than in accordance with the provisions of the highway code) (as to cause a public nuisance)
- revving of engines (as to cause a public nuisance)
- playing loud music (as to cause a public nuisance)
- causing danger, or fear of danger, to other road users and pedestrians
- causing risk of damage to property
- racing
- Repeated sudden and rapid acceleration (as to cause a public nuisance)
- performing stunts, including but not limited to doughnuts, drifting, skidding, handbrake turns and wheel spinning
- driving in a convoy.
- Gathering in a public place in the Restricted Area, for Car Cruising Event(s).
- Congregating and loitering in groups and engaging in behaviour which is likely to cause harassment, alarm or distress.
Offence
Any person who, without reasonable excuse, fails to comply with the prohibitions listed at paragraph 1, 3 and 3 (and any sub paragraphs) of this Order commits an offence.
Penalty
A person who is guilty of an offence for contravention of the prohibitions listed at paragraph 1, 2 and 3 this Order shall be liable, on summary conviction, to a fine not exceeding level 3 on the standard scale or to a fixed penalty notice not exceeding £100.
Appeals
In accordance with Section 66 of the Act interested person who wishes to challenge the validity of this Order may apply to the High Court, within 6 weeks from the date this Order is made, any such challenge must be on the ground that
- The Council did not have the power to make the Order to include particular prohibitions or requirement, or;
- That in making the Order the Council has failed to comply with a requirement under the Act.
Defined Terms
- “Authorised Officer” – means a Constable, a Police Community Support Officer or a person authorised in writing by Bassetlaw District Council
- Anti-Social Behaviour – Includes:
- Obstructing highways, residential or business properties
- Dangerous driving
- Inconsiderate driving
- Excessive noise via engine, horn or amplified music
- Littering
- Verbal abuse including swearing or intimidation to members of the public
- “Designated Area” - The land described by the map in Schedule 1, edged in red, being land in the area of the Council is land to which the Act applies and is protected by this Order
- “Car Cruising Event” - Two or more mechanically propelled vehicles collecting on the public highway or a publicly accessible place and those people associated with the collecting vehicles acting in an anti-social way. It can be either planned or unplanned. although most people attended these events/meetings in their car the definition of car cruising relates to any 'mechanically propelled vehicle, whether intended or adapted for use on a road'. Therefore, meetings using off road motorbikes or quad bikes are also included.
- “Vehicle(s)” - includes a pedal cycle, which includes a power assisted pedal cycle or a pedal cycle in combination with a trailer, constructed or adapted for carrying one or more passengers.
