Policy to aid Officers and Members when dealing with those applicants and licence holders who have previous convictions.

Under the provisions of the Local Government (Miscellaneous Provisions) Act 1976 (“the Act”) the Bassetlaw District Council as Licensing Authority should not grant a Hackney/Private Hire Drivers Licence or a Private Hire Operators Licence unless they are satisfied that the applicant is a ‘fit and proper person’. There is no formal definition or guidance regarding the application the “fit and proper” criteria therefore it is for each Licensing Authority to develop a policy to deal with applications and reviews of licence

The Act also allows the Council to revoke or suspend a Hackney/Private Hire Drivers Licence or a Private Hire Operators Licence in the following circumstances
